Per- and polyfluoroalkyl substances (PFAS) are man-made chemicals found virtually everywhere in the environment. While there is still much to uncover about these chemicals, the EPA has proposed designating certain PFAS chemicals as hazardous substances. Because of these potential changes, many jurisdictions may soon face a challenging compliance environment.

In June 2023, water utilities and providers reached a $1.8 billion settlement in federal court with certain chemical manufacturers in which manufacturers agreed to pay for present and future costs related to PFAS-contaminated potable water being distributed to the public. Other cases are seeking even larger settlements.
