Mitchell Townhomes Project EIR and Technical Studies for the City of Walnut Creek

FCS provided environmental review and CEQA compliance support for the Mitchell Townhomes Project in the City of Walnut Creek. The proposed redevelopment would transform an existing office park into a residential community consisting of 422 townhome-style units, including affordable housing, along with open space, pedestrian amenities, infrastructure improvements both on-site and in the project area to support the proposed development.

As the City's first and only Builder's Remedy project and one of its most significant recent environmental reviews, the project required careful coordination, rigorous technical analysis, and ongoing support throughout the EIR process. 

The City's Challenge: Managing Environmental Review for Walnut Creek's First Builder's Remedy Project

The Mitchell Townhomes Project was proposed under the Housing Accountability Act, including the Builder’s Remedy and State Density Bonus Law. The Housing Accountability Act establishes the process for Cities to review and process eligible projects, without the need for projects to obtain general plan, zoning, or other legislative amendments. Similarly, State Density Bonus Law establishes a process for density bonuses, waivers, incentives and concessions to otherwise applicable standards. Accordingly, the City of faced the challenge of processing the project application pursuant to State law, while also maintaining a comprehensive and defensible environmental and planning review.

Our Solution: Managing Project Changes, Public Review, and Appeals Through a Defensible CEQA Process

FCS prepared the Environmental Impact Report (EIR) and supporting technical analyses required to evaluate the project's potential environmental effects. The team worked closely with the City staff, the applicant team, and technical specialists to help guide the project through environmental review while maintaining schedule, transparency, and regulatory compliance.

During preparation of the Draft EIR, FCS managed updates to the project description to reflect the latest planning applications and the addition of a Community Benefits Variant which included a roundabout and additional bicycle infrastructure in the project area. FCS worked with the City to identify the scope of additional analyses required to cover these changes, including updates to Air Quality modelling and Transportation Analysis. FCS coordinated with the City, Applicant, and technical specialists to provide an accurate and thorough evaluation of potential impacts associated with revised design features. 

The project generated significant public interest, and the City received a large volume of comments during public review of the Draft EIR, including extensive technical and legal comments. FCS collaborated with the City and technical specialists to prepare detailed responses to all comments received prior to hearings on the project. During preparation of the Final EIR, FCS helped the City navigate an extensive public review process. Key activities included:

• Reviewing and responding to 62 public and agency comment letters
• Preparing consolidated responses to recurring environmental issues
• Coordinating technical input from specialists in air quality, biological resources, noise, transportation, and other environmental disciplines
• Preparing errata and supporting materials for Planning Commission and City Council Review

Following Planning Commission approval, the project was appealed, creating an additional layer of review and requiring the City to respond to complex environmental and procedural issues under a compressed schedule. FCS continued supporting the City by preparing an Environmental Appeals Response Memorandum, coordinating technical review of appeal issues, evaluating alternatives, and assisting with preparation for City Council hearings. The FCS team also attended hearings to provide technical support and respond to questions from the community and decision makers regarding the environmental analysis and CEQA process.

Results and Deliverables

FCS delivered a comprehensive and defensible environmental review package that supported the City's evaluation of the project through multiple stages of review and public engagement.
